These Terms of Service (“Terms”) govern your access to and use of the Yours Faithfully website, mobile applications, and related services (collectively, the “Service”).

By creating an account or using the Service, you agree to these Terms and our Privacy Policy.

2. Eligibility

You must be 18 years of age or older to use the Service. By using the Service, you represent and warrant that you meet this requirement and that your use complies with applicable laws.

Age Validation Controls. We require users to provide a date of birth during account creation. You may not use the Service if you are under 18. We may require additional verification (such as phone, email, selfie, or ID) and may approve or deny verification at our discretion, including where we suspect a user may be under 18 or where needed for safety, fraud prevention, or compliance. If we determine or reasonably suspect that a user is under 18, we may suspend or terminate the account and take appropriate action consistent with these Terms and applicable law.

3. Account Rules

• You must provide accurate, current, and complete information and keep it updated.
• You are responsible for all activity under your account and for safeguarding your login credentials.
• You may not create an account for anyone else, impersonate another person, or access another user’s account.
• We may require verification (such as phone, email, selfie, or ID) and may approve or deny verification at our discretion.

4. Community Rules (Acceptable Use)

• Harass, threaten, stalk, defame, abuse, or harm another person.
• Post, share, solicit, or request any sexual content involving minors, including Child Sexual Abuse Material (“CSAM,” meaning any visual depiction of a minor engaged in sexually explicit conduct) (zero tolerance).
• Use the Service for illegal purposes or to promote illegal activity.
• Promote, facilitate, or engage in human trafficking or sex trafficking.
• Promote, facilitate, or engage in incest, bestiality, rape, sexual violence, or any non-consensual sexual content.
• Promote, facilitate, or engage in non-consensual mutilation of a person or body part.
• Solicit, advertise, coordinate, or facilitate commercial sexual services where illegal, or any activity that exploits or endangers others.
• Spam, solicit money, or promote goods or services without authorization.
• Scrape data, reverse engineer, hack, disrupt, or interfere with the Service.
• Post content that is hateful, extremist, or encourages violence.

Safety Reminder: You are solely responsible for your interactions with other users. Use caution when sharing personal information or meeting in person.

5. Reporting Illegal Activity and Safety Concerns; Remediation

We provide a dedicated channel for users and third parties to report suspected illegal activity, safety issues, or violations of these Terms. Reports should be sent via email to abuse@yoursfaithfully.org

Review and action. We review reports received via email, prioritize urgent safety risks, and may take remediation actions which can include removing content, restricting features, suspending accounts, or permanently terminating accounts and blocking access.

Escalation and cooperation. Where appropriate or required by law, we may preserve relevant information and cooperate with law enforcement or regulatory authorities in connection with investigations involving suspected illegal activity, exploitation, trafficking-related activity, or CSAM.

6. User Content and License

“User Content” includes profile information, photos, messages, and other content you upload or share.

You retain ownership of your User Content. By using the Service, you grant Yours Faithfully a non-exclusive, worldwide, royalty-free license to host, store, display, reproduce, and distribute your User Content only as necessary to operate, maintain, and improve the Service and to show it to users you choose to interact with.

You represent that you have all rights necessary to post your User Content and that it does not violate any laws or third-party rights.

7. Paid Features (One-Time Purchases Only)

Yours Faithfully does not offer subscriptions.

We may offer one-time purchases, including:

• A flat fee to unlock the “Serious Level”
• A flat fee to add call minutes within Serious Level

Pricing: Prices and entitlements are shown clearly at checkout or in-app before payment.

No guarantees: Payment does not guarantee matches, responses, compatibility, relationship outcomes, or continued access to any specific user.

Refunds: All sales are final, except where required by law. Purchases made through Apple App Store or Google Play are subject to their refund policies.

Abuse or fraud: We may suspend or terminate accounts for suspected fraud, misuse, or chargebacks without valid basis.

8. Calls and Communications in Serious Level

If voice or video calling is available:

• Call quality and availability depend on third-party services, networks, and your device.
• Purchased call minutes may be forfeited if your account is suspended or terminated for violations.
• You agree not to record calls without consent where prohibited by law (Texas is a one-party consent state, but other states may differ).

9. Moderation and Enforcement

We may remove content, restrict features, or suspend or terminate accounts if we reasonably believe a user has violated these Terms, our policies, or poses a safety risk. We are not required to monitor all activity.

10. Third-Party Services

The Service may rely on third-party providers (payment processors, app stores, call technology, verification services). We are not responsible for third-party services, outages, or actions, and their terms apply to their services.

11. Intellectual Property

All software, design, branding, trademarks, and non-user content associated with the Service are owned by Yours Faithfully. You may not copy, modify, distribute, sell, or reverse engineer any part of the Service without written permission, except as permitted by law.

12. Account Deletion and Termination

You may delete your account through settings or by contacting support. We may suspend or terminate your account at any time if you violate these Terms or to protect users or the Service. Upon termination, your right to use the Service ends.

Certain data may be retained as described in our Privacy Policy and as required by law.

13. Disclaimers

The Service is provided “AS IS” and “AS AVAILABLE.” We do not guarantee:

• uninterrupted or error-free service,
• identity verification accuracy,
• user conduct,
• or matchmaking results.

14. Limitation of Liability

To the fullest extent permitted by law, Yours Faithfully will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data.

Our total liability for any claim will not exceed the greater of $100 or the amount you paid us in the 12 months preceding the event giving rise to the claim.

Some limitations may not apply depending on state law.

15. Indemnification

You agree to indemnify and hold harmless Yours Faithfully from any claims, damages, losses, or expenses arising out of your use of the Service, your User Content, or your violation of these Terms.

16. Dispute Resolution and Arbitration (Texas)

PLEASE READ CAREFULLY — THIS AFFECTS YOUR LEGAL RIGHTS.

You and Yours Faithfully agree that any dispute arising out of or relating to these Terms or the Service will be resolved by binding arbitration, except that either party may bring qualifying claims in small claims court.

• No class actions: Claims must be brought on an individual basis only.
• Arbitration provider: American Arbitration Association (AAA), under its Consumer Arbitration Rules.
• Location: Travis County, Texas (or remote if permitted).
• Opt-out: You may opt out of arbitration within 30 days of first accepting these Terms by emailing support@yoursfaithfully.org with your name, account email or phone number, and a clear statement that you wish to opt out.

If this arbitration provision is found unenforceable, disputes will be resolved in court as described below.

17. Governing Law and Venue

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. If a dispute is permitted to proceed in court, it shall be brought exclusively in the state or federal courts located in Travis County, Texas.

18. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated by email or in-app notice. Continued use of the Service after the effective date means you accept the updated Terms.
